Duties:

*Participating in Working Group meetings to discuss improved methods of locating, documenting and storing trial exhibits, physical evidence, court records, police and lab records, and prosecutor files;

*Working with New England Innocence Project intake team to identify (from the more than 200 pending applications for assistance) all violent felony cases in which there is a possibility that post-conviction DNA testing could yield evidence that is probative of the identity of the perpetrator as defined by Chapter 278A;

*Litigating motions for discovery and access to evidence on behalf of CPCS Innocence Program clients (where necessary) under the new DNA law;

*Coordinating and supporting efforts of court-appointed post-conviction lawyers pursuing similar motions for discovery and access brought under Chapter 278A on behalf of their court-appointed clients;

*Developing training materials and coordinating with Working Group partners to produce a training program for defense attorneys, prosecutors and other relevant stakeholders on issues related to post-conviction DNA testing and access.

The Staff Attorney will fulfill these responsibilities in close consultation with the CPCS Innocence Program Director, with assistance from the Deputy Chief Counsel and Director of Criminal Appeals for the Private Counsel Division of CPCS.

Qualifications:

Candidates must have substantial experience in criminal law, superior appellate and trial litigation skills, and the ability to work independently, as well as in close coordination with other staff. The ideal candidate will have expertise in DNA/forensics and Massachusetts criminal law. Applicant must have a strong commitment to representing indigent clients and excellent legal research, writing and presentation skills.

Comments:

The CPCS Innocence Program Criminal was created in 2010 in order to identify potentially meritorious Massachusetts innocence cases, provide legal support and oversight to post-conviction attorneys assigned to represent indigent clients identified as having potentially meritorious innocence claims; train lawyers on forensic issues and litigation skills related to wrongful convictions; and administer an ?Expert Funding System? to support post-conviction investigation, forensic expert consultation and testing.

Please note that this is a grant funded position, and funding is only guaranteed for an eighteen month project period as budgeted in the grant award. While it is anticipated that additional funding will be sought in the next grant application cycle, funding for this position is only guaranteed for the duration of the project period budgeted in the current grant, which is 18 months from the start of employment.

The projected start date for this position is in early January.

Salary is commensurate with experience, but will be considered a lateral move for any current CPCS Staff Attorney.
